Rep. James fagan’s response to Jessica’s Law
This is a real case of the meida running with a hot sotry and not really looking at the facts. James Fagan had to have been saying this to demonstrate the risks of putting a child on the stand and showing hat lengths a defense attorney would go to defend his client.
I think he is right. The duty of the attorney is to his client not to the well being of anyone else- including a small child.
I am certainly not PRO treating children this way and I doubt Joe Fagan is either- he is merely demonstrating how bad it could get for the child.
The answer is not to let a defense attorney to be abusive to a child or give the witness (a child) in a death penalty case special rights – child but to not put them on the stand in the first place.
This is a constitutional issue- not about Joe Fagan wanting to destroy a child.
The Massachusetts State Legislature is debating “Jessica’s Law” — named after Jessica Lunsford who was sexually assaulted then murdered in Florida by Florida by a repeat sex offender. Representative James Fagan said he’d
“rip apart” 6-year-old victims on the witness stand and “make sure the rest of their life is ruined.”
In a fiery soliloquy on the House floor, Fagan said he’d grill victims so that,
“when they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody.”

I can’t believe that we have elected people like this! He has threatened victimized kids everywhere! I sent him an email citing an example of a lenient judge in Vermont. I also posted my email on my blog if anyone wants to read it: http://averagepolitics.wordpre…..tens_kids/
I can’t believe this guy has kids and could say all of that! I guess he doesn’t think his kids would ever be victimized!
